What it means when you sign

This article gives the consumer the right to claim compensation for personal or material damage caused by using the commodity or service, in line with the legislation in force in the State. Any agreement made to the contrary is void. A second paragraph sets out an exception: damage that results from misuse, or from use in a way that goes against the method of use, falls outside the right.

When you are about to sign a consumer contract, this article means that a clause saying the consumer gives up the right to compensation for injury or loss caused by the product or service may be void. That includes wording such as a waiver, a disclaimer of all damages, or an agreement not to claim. At the same time, the provider is not answerable for damage caused by misuse or by using the item against its instructions, so clauses and instructions describing how the commodity or service is meant to be used are worth reading. Look for liability waivers, limitation wording and the stated method of use.
