What it means when you sign

This article covers what happens when the landlord tells the tenant to leave and the tenant stays on after the lease has expired. If the landlord has served notice of eviction and the tenant nevertheless keeps using the property after the lease expires, renewal of the lease is not presumed unless proof shows otherwise. If the landlord notifies the tenant to vacate unless the tenant accepts a new rent or other new terms, and the tenant stays silent, that silence is treated as acceptance and the lease is renewed implicitly at the new rent or on the new terms.

For a contract about to be signed, this article is relevant to clauses on renewal, rent changes and notices. It means a notice of this kind can lead to different outcomes depending on what it says: a plain notice to vacate does not by itself renew the lease, while a notice offering new terms can bind a tenant who says nothing. How a notice is worded, and whether a reply is given, can therefore decide which result applies.
