What it means when you sign
This article deals with a rent increase asked for after the lease term has ended. If the landlord requests a specific increase on the stated rent after the term expires, and the term runs out while the tenant stays in possession of the property without objecting, the tenant is treated as having accepted the increase.
For a contract about to be signed, this article is relevant to clauses on rent review, renewal and holding over. It means that silence and staying on can be treated as acceptance of a new rent figure. Whether a rent increase takes effect can therefore depend on whether the tenant objects, and on what the tenant does after the landlord asks for it. When reading a lease, it is worth checking how rent increases are to be notified, whether the lease states how and by when a tenant must object, and whether it fixes the rent for any renewal. A clear written objection is the opposite of the conduct this article describes.
Not yet cited in a Fahm report; shown because it sits in the same chapter as one that is.
