What it means when you sign

This article sets out when the tenant must pay the rent. The tenant pays at the times agreed in the contract. If there is no agreement on timing, the rent is paid at the times determined by custom.

For a contract about to be signed, this article is relevant to the clause on rent and payment dates. It means the dates written in the lease are the first thing that counts. If the lease is silent on when rent falls due, the article points to custom as the fallback, which may not match what either side expects. So the payment schedule is worth stating clearly: how often rent is paid, on which day, whether in advance or in arrears, and how it is paid. A lease with vague wording on timing leaves the due dates to be filled in by custom, and unclear due dates can lead to disagreement about whether a payment is late.
