What it means when you sign

This article covers what happens when the leased property is lost or damaged during the lease. If it is destroyed completely, the contract is cancelled automatically. If it is partly destroyed, or becomes unfit for the use it was rented for, or the enjoyment of it is substantially reduced and the tenant had no part in that, the tenant may, if the landlord does not restore the property within a reasonable time, ask the court for either a reduction in rent or cancellation of the lease. The tenant may also carry out the landlord's repair duty under the maintenance article. In both cases the tenant cannot claim compensation if the loss or damage is due to a cause the landlord is not responsible for.

For a contract about to be signed, this article is relevant to clauses on damage, loss, rent abatement and termination. A clause that removes the tenant's right to a rent reduction or cancellation in these situations may run into this article.
