What it means when you sign
This article sets out who can make an arbitration agreement and on what. Only a natural person with the capacity to exercise their rights, or a representative of a legal person who is authorised to conclude the arbitration agreement, may enter into one; otherwise the agreement is null and void. An arbitration agreement cannot be made on matters where conciliation is not allowed. Where the Law lets the parties choose a procedure, any party may authorise a third party, including a person or arbitral entity inside or outside the State, to choose or decide it. Unless the parties agree otherwise, the agreement does not end on the death of a party and can be carried out by or against the legal successor.
When you are about to sign a contract with an arbitration clause, this article means that the person signing must have authority, and that the clause may not cover matters that cannot be settled by conciliation. Check who signs for a company and what the clause covers.
