What it means when you sign
This article lists the general obligations of the controller, the party that decides how and why personal data is processed. The controller must take appropriate technical and organisational measures to protect and secure the data and to prevent breach, destruction, alteration or tampering. It must apply suitable measures when choosing the means of processing and during processing, including pseudonymisation, and must limit processing to its purpose in terms of the volume and type of data, the type of processing, the storage period and access. It must keep a special record of personal data, which it submits to the Bureau on request. It must appoint a processor that gives sufficient guarantees, and provide the Bureau with information it requests under a court decision. The regulations may add other obligations.
When you are about to sign a contract involving personal data, this article means that if a party is the controller, these duties fall on it. A clause naming a party as processor, or sharing data with outside providers, may relate to the duty to appoint a processor with sufficient guarantees. Check which party carries the security, record-keeping and processor-selection duties.
